    Can i move my children back to my home country without father's consent? I'm polish and lived in England for 20 years my children where born in England but are registered in poland and England. I'm looking to move back home to poland and taking my children with me. Me and there dad are separated, he also currently lives in England. We have always sorted are own arrangements out when it come to having the children.

      Would this apply though as both myself and their real dad are Polish? I want to move back home after our marriage has broken down and we have divorced. He wants to stay but I don't. I have the children living with me I don't understand why this should stop me. I have no family here in England. My kids have both Polish and English citizenship, there passports are also also Polish and British.

        The parents nationalities are not relevant & neither are their children's. The legal question is:What is the habitual residence of the children? From the OP's writing, the answer does seem to be the UK.
