    It will help the other side but strong contradictions in evidence will make the CPS think twice. They will look at the history of police call outs to the address and all other background information to make their decision. As magistrates (this is the kind of case we would hear) we have to be SURE to convict so a well run defence would be likely to win the day. All depends on the huge amount of information behind the accusation.

      The CPS also consider whether a prosecution is in the public interest.

      They and the police may not regard this as the highest priority.

        CPS are being told to pursue any domestic violence case - Home Office are determined to increase the conviction rate. They've also introduced some new offences. It's a really bad time to have been accused.

        But, even if I were guilty of what she has alleged - and I KNOW I'm not - the marriage is over, I won't be seeing her or her son again and there's a reasonable chance that they will be leaving the UK in any case (if her DV application goes the way it should). And I have a clean record and I'm 60. So I'm struggling to see what the point is in convicting me.

            I needed some insight into the issue of the hacking/potential crime. Other questions were asked, so I've tried to expand in order to give more info. People have kindly provided additional info on that expanded information - including you! Isn't that how it's supposed to work?
