  • Possible Contempt

I have 18 months into the most hellish of court situation wtih my ex partner. I have chosen to self-represent mainly because this is the 4th time that I have had proceedings brought against me and its cost me an absolute fortune. Recently, my ex partners wife was Ordered to send in a statement as part of the proceedings - she has completely lied in her statement - without going into the finer details I wanted to know if I can bring a Contempt application - I can prove the lies. Further she has sent in her statement in her own capacity as a lawyer, although she doesnt appear on the SRA register - do lawyers have to be on the SRA register - there seems to be a fine line between a lawyer and a solicitor. IF I proceed wtih a contempt application I have just very roughly looked at the Form FC600 application which costs £167 to apply for. However it says do I need permission to apply which I presumably do - in this case which form do I use for the permission to apply or do I just send a letter? there is also Form N600 which is around £35. I'd really appreciate any urgent help or advice on this please. TIA.

First of all, my advice is to concentrate on the case. Prove or disprove what you need to prove or disprove. Let the judge make conclusions.

Maybe then, in the light of the judge's findings, might the time come to look at this kind of thing.

But until then, deal with the case. Don't let yourself be distracted from it.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

Let the judge find her lies to be such. It is at that point, and not before, that you worry about contempt. Atticus is right - concentrate on winning the case.
