  • Contact order breach

    Hi all, I was wondering if anyone had this issue before… we are divorced parents of one child, with a very detailed contact order in place. Due to both parties bringing courts applications in all the time, we currently have s91(14) in place, applicable to both parties equally.
    The other party decided to not follow the order and did not hand the child for contact, instead went on holiday with the child when the child should have been in my care. This is a clear breach of the order and the other party is aware of it but doesn’t seem to care.
    What can I do about this, especially with the s91(14) in place? Any advice would be greatly appreciated.

        I am sorry but family law is not my area. I remember once thinking it might be and sitting in on a case being heard in family mags. Exactly the same situation - dad had gone to pick kids up only to discover mum had taken them on a holiday with new partner. Clearly it had gone to court. I can only suggest contacting a family solicitor or the court?

          Many solicitors will offer a free 30 / 45 minute consultation, that should give you a good idea on where you stand.

            Thank you guys, I appreciate your help. I just wasn’t sure if I’d need to get the permission (s91(14)) first or could go for the enforcement order as it’s a breach. Thank you again.
