I am the custodial parent, in 2016 I agreed to let my ex claim two of our children every year and this is noted on our custody papers. He has claimed them in 2017, 2018 and 2019 but has never had me sign the form 8332, she he obviously has been lying to the IRS by clicking the box that indicated the kids have lived with him at least 6 months of the year when in fact he only has them every other weekend. Things have changed the past year and half, long story short he hasn't had an overnight in over a year. Because the claimed the kids last year he of course got both stimulus checks for them and he plans on filing the same this year. I am considering filing them as well this year if he once again fails to have me sign the 8332 document, I know I will get my hands slapped by the MO courts but they do not trump Federal Law. I am just writing to see what happens when the non custodial parents files his taxes claiming the kids but never has me sign anything? Does that give me the right to claim them? I know I can go back 3 years as I should have gotten the EIC on them and not him had he done everything correctly. Anyone ever dealt with this before?
