  • How to obtain solicitor for children

    hello,

    Can somebody tell me how to request of a family court that my children have their own solicitor in family court proceedings? They are 10 and 15. Is it necessary to ask the court to appoint a guardian?
    I represent myself as I cannot afford a solicitor for myself before somebody tells me to ask my solicitor.
    I would ask for legal aid for the children.

    Hi Committeddad,
    Just to clarify are these private law proceedings such as a contact issue, or are these public law proceedings ie care proceedings.
    Under the Children Act 1989 the court should have regard to the ascertainable wishes and feelings of the child concerned (considered in light of their age and understanding).
    In private law matters such as contact issues it is unusual for a Court to make orders for older children as they will invariably vote with their feet if they disagree with any order made.
    If this is a contact matter then the Court may appoint a CAFCASS officer to speak to the children and ensure their views are taken into account.
    If you could confirm the type of proceedings you are involved in we may be able to point you in the right direction.
