  • Schedule of Allegation summary statement letter

    Hi,

    A friend of mine is currently being taken to court by her ex-husband over custody rights to the children. The usual domestic violence story, towards her and the children. Solicitors are expensive, and she cannot afford them. After her first court, the judge ordered her to submit a Schedule of Allegations, supporting documents and a summary statement. I helped her with these documents, and we sent them to her ex for his opportunity to respond to each allegation. We just received his responses and summary statement. He can afford a Solicitor. So when we saw how his lawyer had drafted the summary statement, we realised ours was incredibly underdeveloped.

    We have one day to submit the entire package to the family court. The question we have is, can we rewrite our summary statement? Or do we have to keep the original draft?

    Also, can we amend our allegations in light of new evidence that arose after sending him the original Schedule?

    Thank you greatly to anyone able to answer these questions, especially the rewrite... that is our main concern.
