    HI PEOPLE,

    I HAVE BEEN DISMISSED FOR GROSS MISCONDUCT. AS SUCH I UNDERSTAND THAT THE CAR AND ALL RELEVANT PROPERTY MUST BE RETURNED TO THE COMPANY.
    HOWEVER, APPROXIMATELY 18 MONTHS AGO i PAID £309.00 TOWARDS A MOBILE 'PHONE FOR USE IN MY WORK. I WILL RETURN THE SIM CARD WITH "THEIR" TELEPHONE NUMBER, BUT CAN I KEEP THE 'PHONE (HANDSET) UNTIL THEY REIMBURSE THE £309.00?

    This all depends on the contract when you took this out.

    What kind of contract was it and what were the terms of the contract with your former employer?

    Some providers will have an airtime balance and a handset account examples of this are
    02 refresh
    virgin liberty
    02 business essentials

    Were you liable for the handset part of this? If so and this is clearly agreed than you can keep the handset, I would assume if they had a recipet for you paying £309 they should allow this or refund it if this was a 50/50 purchase.

    What have your former employers said with regards to this, if you post up the tariff name I may be able to help futher.

      Thanks Slainte,

      The contract is a "Corporate" deal between the company and EE. Having said that, it is billed directly to me in my name - I had to claim the costs back on my expenses. When I first ordered the handset I tried to claim the full amount, but that was refused and I paid £309.68 of my own money.

        Ok so the bill is in your name and you paid for the phone, did you pay outright for the full amount of the handset cost? If so you have bought the handset outright and it is yours.

        If you pay the bill and claim expenses, it is possible that you own the number and SIM card, ensure that if you do hand them back the contract is in the company name and that you are not liable for termination costs if appropriate.. get it in writing too!

        What tariff are you on? If you have bought the handset straight out you may be on a short term contract anyhow but it is worth checking.

          The amount of £309.58 was the cost of the handset less a £200.00 allowance by EE for paying by monthly direct debit.
          The contract was called "Corporate Fifteen"

          The company will bear any termination cost and I am happy to hand them the sim card and number...

            From what I am reading you have paid the phone in full then.

            I would say that as long as you have proof (bank statement/reciept) of the transaction you have every right to either keep the handset or be paid what you forked out... make sure you get that your company have taken over the contract in writing from the company though!

            I would suggest contacting your former employer and asking which they would prefer, the handset back and refund you or you keep the handset and leave it like that.
