Posting for my daughter's partner. He gave his notice in as he has another job he also gave back the company car. The firm state they will not be paying him for the time he has worked since last pay. What can he do?

Did he work his notice or did he just hand in his resignation letter and leave? If he worked his notice then he is entitled to pay up until his last working day, including any accrued by untaken holiday entitlement. However if he left the same day and did not work any notice then he has breached his contract and this could be why his firm have decided not to pay him any money. What was his contractual notice period?

In his contract it says if he doesn't work the garden leave if asked he will lose payment for holiday and the notice period... but Acas have said it is illegal to not pay someone what they have worked.. he had a whole month he has worked and not been paid forComment

It would be really helpful if you could let me know the date he resigned, his contractual notice and the last day he worked. If you could also post up the bit in his contract (redacted if you necessary) about leaving the company that would be really helpful then I can provide specific support.

Thank you I will deal with at weekend but they have said if it goes legal they will delay at all cost they said they paid a referral fee for him so that's why they won't pay he has been there over 3 months so lose the feeComment
