  • No contract and possible no payment

    Hello. Couple of days ago I started working for a company and the employer sad that i`m gonna be payed weekly but recently I found out that he`s paying people cash every day. I don`t have a contract with the company and I`m afraid that he`s not gonna pay me. What are my choices if he`s gonna refuse me to pay?

    You have an implied contract by just working there. the others may have a contract whereby he pays them on the days when they turn up, not your problem. So wait will the end of the week and see if you get paid. No pay then walk out.

        They are supposed to supply a contract but they do have time to supply that to you, and I can't remember how long they have to do it. In the meantime you have, as I said, an implied contract that gives you things like notice period, holiday entitlement etc. I certainly wouldn't want to work for a company that didn't pay me without good reason.

          As [MENTION=39331]ostell[/MENTION] says you will need to see what happens at the end of your first week and see if you get paid.

          An employer must give employees a ‘written statement of employment particulars’ if their employment contract lasts at least a month or more. This isn’t an employment contract but will include the main conditions of employment. The employer must provide the written statement within 2 months of the start of employment.

            It`s been only 3 days but it`s really a big company in this country, everybody heard about them. I`ve worked for them in another town and they did the papers really quick ( first or second day), but in here seems like they don`t bother with something like that.
            I`m gonna wait next week as well and if it`s not gonna pay me I`m thinking to take a lawyer.

              I would suggest that there will be a few things that you can do first to try and get any monies owing before having to instruct a lawyer which may end up costing more that the salary owed.
