  • Unfair dismissal due to reorganisation

    My employer has had a reorganisation and, in effect, I was told I was being demoted. I applied for and was successful at interview for a higher position but there were not enough positions available locally. So they offered me a job miles away and it was not viable for me to move. I therefore resigned but they are saying that my position was never that which I have worked since starting at the place - ie the job I did was middle management but they say this was only temporary and the extra pay and duties could have been taken away at any time depending on the needs of the business. However, this is the only position I have every held and I would not have applied for the lower position. I therefore think, to make me now do the lower paid job is a demotion but they are not having it. I have been through the ACAS Early Conciliation and the company does not want to enter into any discussions re settlement. So I have no choice but to take it to tribunal. My contract says nothing about the lower job - my job title on the contract is that which I have done. Does this make any sense and does anybody think I have a good chance of success?
