  • Delayed hearing, witnesses uncalled?

    I have a hearing in 2 months that has been delayed for over a year. My former employer called a colleague of mine as a witness and has now sacked her (that's 5 in a row). He controlled her statement to a degree apparently, she certainty wasn't free to say anything that didn't serve him.

    She is still willing to come but he has now written to the tribunal to say he won't call her anymore. I've replied to say that I will. She is preparing a further witness statement at the moment. We haven't discussed the contents of this or even what she remembers - after I left she was forbidden from contacting me. However I believe her recall of the events will cement my claim as she was stood next to me when it happened and I know he was moaning about it after the event (sex discrimination and constructive unfair dismissal).

    We are all legal professionals (claimant respondent and witness), although not in this area of law. My former employer is a really unpleasant man who has committed every employment sin possible including sexual harassment of my 19 year old former colleague (which he then apologised for and admitted to her in writing afterwards but she didn't take any action).

    Can he simply withdraw her at this late stage, and if he does can I submit an updated witness statement to the tribunal? The document and statement exchange was completed way back last year.
