  • Training Agreement

    Good evening,

I have had no luck finding a concrete answer to this so any advice would be appreciated. Where do I stand on the following?

My employer agreed mid 2015 to pay for a training course that they had promised they would during the interview and it is the 'norm' for them to pay for the course for employees at my level. The course involves eight weeks or so away from work and costs several thousands of pounds. It is a requirement to have completed this course if you are to progress within the company at a later date.

So I received a signed training agreement clearly stating that the employer would pay for this course as of November this year. I then forwarded this proof onto the training provider who booked me onto the course. In return, i signed a return of service agreement with my employer stating if I left, was fired etc I would pay back the course costs at an incremental rate of 1/36th of the course for each month remaining of the 3 years. Fairly straightforward.

I called my employer today to confirm everything was alright with the dates for the study leave, to be informed that actually they have recently decided they aren't paying for it anymore. And not only are they not paying for it going forward, but every approval since April 2015 will now not be paid for, but we are welcome to pay for it ourselves...

This was not a formal announcement, just an off the cuff statement. Shortly followed by another 'unofficial' email announcement.
    I see several issues here:

    1. They have reneged on an agreement.
    2. They have not informed employees in an adequate time period.
    3. They have verbally promised something in an interview which they are now not following through.

Any comments on the legal standing of further reading would be very much appreciated?!

Hi Deckie & welcome to LB

Does the course lead to a nationally-recognised qualification?

      Hi there,

Thanks for the reply. It does lead to a nationally recognised qualification.
