    I posted another thread on this subject, but this question is more about a specific issue.

    In this are 3 people.

    The woman, she unfortunately has a family member who committed a serious crime, so should be protected by safeguarding. She also has a son at the school, who should also protected by this same safeguarding, as revealing who their relative is could cause harm.

    An Asian teacher, herself a victim of this other teacher.

    The teacher. The centre of everything going on.

    The issue:

    The teacher, she decided to tell some student teachers who were working at the school, about the woman relatives. A direct breach of safeguarding. The student teachers then went back to their Uni, and told their tutor, and they apparently had a lesson on whether this woman was fit to work in a school. This incident obviously also revealed the woman's child in the school as a relative of the criminal to people who did not need to know.

    The Asian teacher knew what she had done, and was also told about this by the student teachers, so complained to the school in November. And since then another 3 times. The school have not spoke to the woman to tell her that her and her child safeguarding has been breached. This is 5 months now. The school (Academy), back in January said this incident was over to the Asian teacher due to lack of evidence. They never bothered to ask the student teachers, or their tutor about that was revealed to them. So the Asian teacher complained to the police, and now all of a sudden the school say it is not over.

    Would the Asian teacher be breaking any rules, or would she get into trouble, by telling the woman about this directly, as she feels the school have failed to protect her and her son?

    Has a criminal act taken place or even a breach of Data Protection Act 1998?
    Is she a member of the Union cos I think discussing it with a union member(not a rep at the school but possibly regional level might be of use to her to discuss what has happened and the school's failure to take any action whatsoever)?

      That's what we are unsure of. The woman is in a union, but the 'unofficial' rep there is useless. He's scared of the school. She will go regional.

      The woman SAR'd the school. They told her she has to get a written SAR on behalf of her son as some of the data is his, and it must be written?. So she got her son to write one, took it in this morning with the £20 for both of them, and now the receptionist is refusing to accept the SAR, saying she cannot take the cash. Can she do this?

      I think they do not want the woman to get hold of the data is it's dynamite.

        Ok, you need to ask the school what method of payment for a SAR they are happy to take ie if not cash then card payment or cheque or postal order. They have to accept one form or another(I'd never give cash personally).
