Yes the employer can refuse your attendance at the meeting as it's not a statutory right. The best thing to do is to prime Anthony for the meeting after all if this went to a Tribunal I am 100% certain they will find in Anthony's favour. The meeting needs to be treated as an appeal meeting following dismissal. It's is highly unlikely that the employer is going to change his mind. Anthony will then need to make a decision if wants to head to a Tribunal given the cost involved.

    It is statutory right pursuant to the Equality Act for disabled people, also based on European Treaty Articles and relevant Employ Directives for 'associations to or with with disability whether direct or indirect. The employer has to ensure that owing to the OP friend's dyslexia that he is not worse off than if we were to have his friend in the grievance meeting, appeal hearing.

      He went down the greivance route on the advice of the CAB. Perhaps this was because on the letter from employer stating that he was being 'laid off' he wasn't given the chance to appeal?? He did not attend the meeting as 2 days before he was admitted to hospital for suspected kidney stones/abdominal pain, a letter was sent to employer informing him of this and giving permission for the meeting to go ahead without him, answering questions set out in greivance letter. Anthony only has 3 weeks left until tribunal deadline so it looks like it's going down the route. He is on ESA at the moment so shouldn't have to pay tribunal fees should he?

        It is about whether he has an income below the fee remission threshold claim to avoid paying tribunal fees. It is 3 months deadline for disability discrimination. It is 6 months deadline for unfair dismissal.

          It wasn't very prudent of the CAB to take him down the grievance route if its effect is little time left to prepare for an employment tribunal. Why has it taken so long?

            Unfair dismissal is also 3 months and not six months. I think Anthony needs to file his case a.s.a.p. He might be able ask for extra time though.
