The contents of the report does not by itself prove or disprove a disability. It is the law that determines what is and what is not a disability. It may not be fair to have a preliminary hearing if it relates to the Equality Act protection for disability, too. What is the disability you claim? What evidence do you have of it? The preliminary hearing is to do with the disability status issue, as well as time bar, as they are trying to say I was late in filing my claim. I wasn't though, so it should be ok. They are also trying to have most of my claims thrown out due to no reasonable prospect of success. I intend to prove that there is indeed a real chance of me winning. They're clutching at straws now, I feel.
