        The contents of the report does not by itself prove or disprove a disability. It is the law that determines what is and what is not a disability. It may not be fair to have a preliminary hearing if it relates to the Equality Act protection for disability, too. I believe there was a case on s.132, Equality Act 2010.

            The preliminary hearing is to do with the disability status issue, as well as time bar, as they are trying to say I was late in filing my claim. I wasn't though, so it should be ok. They are also trying to have most of my claims thrown out due to no reasonable prospect of success. I intend to prove that there is indeed a real chance of me winning. They're clutching at straws now, I feel.
            What is the disability you claim? What evidence do you have of it? If the disability specialist does not support your claim that could be an issue.
