  • Suspended from work, but I'm a contrator!

    This is a peach. I hope you like it but can offer some guidance.

    I'm a contractor and have been working with a public sector body in Scotland for 10 months. I was asked to attend a meeting yesterday with an HR advisor. I thought this was odd as I am a contractor and employed thru an agency. However, I attended and was alleged to have commit an act which I will explain later. I was asked to respond and I said it was unfounded. The advisor then asked for my staff ID and said I couldn't return to work until this has been investigated. I restated that this was unfounded. No matter. I was escorted off the premises. This was about 2:10pm.

    I had left an email for both my managers to say I had been called away, and around 2:15pm one phoned to ask what was up. I explained and he exploded with anger - not to me, but at HR. After a short conversation, he rang off. I later learned that he had mentioned this to a colleague who immediately expressed her guilt. I understand that by approx. 2:30pm the guilty party had confessed to the act to the deputy director, and said I had nothing to do with it.

    In the meantime, its the day later and I am sitting at home, with nothing in written about the allegations. I phoned the HR advisor at 9am and left a voicemail asking for a copy of the policy I was alleged to contravene, I gave her a deadline of 2pm today. That has since past with no correspondence.

    Oh and the act I was accused off? Putting laxatives in my milk.

    We have had incidents of items going missing out of the shared fridges at work. There was a discussion about contaminating milk to flush out the thief. A young colleague took it upon her self to put laxatives in her milk. I must have been overheard talking about it, and I was then shopped to HR as the guilty party.

    I understand that the guilty party, a staff member, is still in post, whilst I am still suspended.

    Basically, what can I do? I intend pursuing my loss of earnings, and potentially a defamatory fee. Anyone got any ideas. I'm in Scotland,

        In that case it might be a good idea to forget about the defamatory fee, it's likely to lead to unhelpful defensiveness.

        Rather than contacting them yourself, you could get your agency contact to call HR to say something like: they've heard that the misunderstanding that led to your suspension has now been cleared up. They could say that you're keen to return asap. and get confirmation that you will be paid for the temporary administrative suspension.
