  • Previous employer wants to claim back overpaid wages after three months

    Hi

I resigned from my job in November 15 following the companies announcement that the department I worked for was to undergo a restructure and that the company car entitlement was to be removed.

I explained my reasons for my resignation and my line manager confirmed that I could give two weeks notice instead of the required four weeks. She also confirmed to me that I would receive a full refund for the extra accessories that I had paid for on a company car which was on order at the time (£466).

For the past three months I have been e-mailing, calling, making complaints trying to get payment but the majority of my correspondence has been blatantly ignored. I finally received an e-mail from the manager earlier this week apologising and advising me that the payroll department had refused to pay the money back due to a possible overpayment on my salary. The manager even stated to me in her e-mail that the payroll department at one point had even told her that the money had been paid into my account which was a blatant lie.

Now I've received an e-mail from the payroll department telling me that because I was paid up until the end of November but left on the 13th of November that I owe them a sum of over £700. In the breakdown they have provided it states 'amount paid in November due to late leavers form' I know for a fact that my line manager only sent my leavers form the day before I finished and i have already received my P45. They have also advised me that they will be writing to me to request the money back.

Since leaving I have only been employed on a temporary basis and my current contract runs out on the 26th February 15 so at the moment technically after that date I will be unemployed.

Any advice would be greatly appreciated. The company in question is a large corporation with very little consideration for its employees so I'm not expecting them to be sympathetic.

    thanks

    IMHO

    Your salary payment was PILON.

I don't think that they can 'offset' money in this way.

It would be classed as wrongful dismissal

But better to seek the experts' opinions.
