It's been 18 months since I was dismissed and I finally have my employment tribunal next week and have requested reinstatement. The reason it's taken so long is because the respondent postponed the hearing 3 times. I now think they will use this length of time to say reinstatement is no longer viable. In my opinion, had they not postponed then this would not be an issue also, people can be off work for 12 months on maternity or longer if long term sick with no issue about time being a factor in returning to work. Would the fact it's been 18 months rule out reinstatement?

Re: How long before reinstatement is not a viable option?
Would you want to go back?
What are the details? (ie, what were the train of events leading up to ET?)
You must have had a good reason to go that far, given the exorbitant tribunal fees nowadays.CAVEAT LECTOR

Re: How long before reinstatement is not a viable option?
Believe me I don't want to go back but if I want to get my career back on track then I have no choice but to go back. Its taken almost 20 years to get were I was, not all with this company, and now because I was dismissed I cant get another job at that level. They have effectively killed off my career on nothing more than jumped up charges because they took a dislike to me when they took over the business. ET was the only way I could see off getting my job back I just didn't think it would drag out this long.

Re: How long before reinstatement is not a viable option?
Does your former employer currently have any suitable available roles?
Or can you evidence that over the last 18 months they have regularly advertised vacancies for roles that would be suitable for you?

Re: How long before reinstatement is not a viable option?
There are no suitable roles available at the moment that I know of. They have advertised suitable roles quite a few times over the last 18 months and had recruitment opens days, but I didn't think to gather evidence and my solicitor never told me to. A quick search on google brings up some results but when you click on the actual link, the page with the advert has long gone.
