  • Compensatory awards

The maximum compensatory award I could get for unfair dismissal is 12 months pay. From that award they take out an amount for any benefits you received. What happens if it takes 2 years for the case to reach tribunal, and you were on benefits for those two years; do they take 24 months worth of benefits from the 12 months worth of pay you were awarded?

No, benefits are only recouped from the period covered by the award. If the award was for less than 12 months then they would only recoup for that period.
