  • Breach of Contract?

    I started working for a company over 2 years ago and was originally on a zero hours contract, this was changed to 37.5 hours. I wanted a transfer to another site, and this was granted. The only catch, was that I was told it would be a 30 hour contract, verbally, (even tho my hours of work would always be 37.5 at least, as it was on a set rota) This new contract never materialised and I had a further verbal agreement with the manager that she would change my hours on the system to 37.5. Again this never materialised.

    I have been working 37.5 hours a week on the rota for the past 18 months. It was only recently that I realised, after speaking to one of my colleagues who was in the same predicament, that I was losing out on 1.5 hours pay for every holiday day that I take, because they say my contract is to work 30 hours over 5 days, 6 hours a day, even though I actually work 7.5. I questioned my contract with HR and they say I am on the system as a 30 hour contract.

    Bearing in mind that my colleague spoke to HR and they honoured his older written contract and reimbursed him for the hours he had lost.

    Recently they have had to cut back on hours, as they are over spending on staff, so have cut my days down to 4 per week 7.5 per day to make up the 30 hours.

    Can I insist they honour the contract that I have stating 37.5 hours, even on the grounds that they have already honoured the same contract for another member of staff.

    I should also add that the manager that dealt with me has long left the company and HR are basically calling upon me to PROVE that I was told I was told I was back on 37.5 hour contract.

    I am extremely frustrated by the whole situation, and seriously considering leaving.
