  • Reinstatement after winning appeal against incapacity dismissal

    Can anyone help me with this query? I won an appeal against incapacity dismissal earlier this year. After waiting several weeks to hear the outcome of my appeal, I was advised by my employers that I had won my appeal, but my reinstatement would depend on me agreeing to take up a different post, as it was felt a return to my original post would be difficult in relation to my management team and the fact that I had won my appeal against the dismissal that they had instigated. I started in my new post in July and some five months later having given it my best shot, feel it is simply not an ideal job for me. My commute to work has increased substantially and the job I was allocated does not compare at all to the one I lost due to my incapacity dismissal (it is a lower grade post albeit my salary being protected, much less challenging and really a junior post to that which I lost). On reinstatement there was no discussion or information provided in writing about what would happen if I was dissatisfied with my new job. There has been no management follow-up of how I am progressing and I feel that taking this post has proved detrimental to me, despite having won my appeal. Can anyone advise me of my rights in this situation?
