• has my employer changed ? is is private case or tribunal case ?

im self employed as a sales / assessor . the company i work for is part of a large uk plc company , under which are about a dozen companies selling similar products . ive swapped over to one of their other companies last week . does this now mean ive changed employers ? the name on my documents and under which my money is paid is my employer , not the plc name . i never deal with the plc , only know that my employer is part of the plc companies portfolio .

reason im asking is i would like to challenge being underpaid commission , but i dont know if i do a private case against them , or if i do an employment tribunal case ? i have posted the commission question seperately , but wanted to post this question as its own thread to save confusion .
thanks guys , sp1n

Hi sp1n - if you are self-employed then you do not have an employer, in which case your employer cannot have changed.

If there is no employment relationship because you are self employed, a Tribunal would have no jurisdiction and so it would be a county court claim.

Even if they say you are self employed, though, it isn't necessarily so, try this checker https://www.gov.uk/guidance/employment-status-indicator

Hi sp1n - I'm guessing this in relation to your other post. As stevemLS said, you will have to pursue your claim through the county court.
