Can I claim back lost benefit value of delay in getting company car

  • Can I claim back lost benefit value of delay in getting company car

    I started a new role in March 2014 and was advised I'd be entitled to a 'job needs' car.
    I didn't actually receive the car til November 2014.
    I feel I lost out on the benefit of that car having puchased a brand new car myself 18 months earlier which was rapidly depreciating in value over the 8 months I had to wait for the company car, plus tax, insurance etc.

    Unfortunately my role is now becoming redundant, and the company have offered to pay me £446.56 per month to be without the car during my 12 weeks notice. This has made me question even more the 8 months I was without the company car.

    Am I within my rights to request 8 months x £446.56 for the lost benefit ?

    As an ex company car driver I wonder if you have thought out all the implications of what you are saying
    1) Did you receive any private use expenses during those months that would not have been paid had you had a company car?
    2) How much tax did you save in not having a company car
    3) How much extra depreciation was there on your car
    4) Does the company car include private mileage

    having a company car is not the perk it was many years ago and the tax bill can be hefty say £200 PCM

      1) Did you receive any private use expenses during those months that would not have been paid had you had a company car? - No, each time I had to travel I had to hire a car ( hire was paid by the company )
      2) How much tax did you save in not having a company car - Tax on income I saved £95 per month
      3) How much extra depreciation was there on your car - My own car was depreciating at a rate of £235 per month
      4) Does the company car include private mileage - no, I only claim business mileage, private mileage I have to pay for myself

      having a company car is not the perk it was many years ago and the tax bill can be hefty say £200 PCM : I agree it's not quite the perk it was but it still worked out for me to be a lot less expensive than having my own car and a lot less hassle i.e. no longer having to shop around for insurance, tyres, MOT, servicing, breakdown cover etc. It's been great with the company car cos I just had one phone number to call for everything car related and they sorted it.

        Your figure of £235 per month seems very precise unless you were leasing it and could have handed it back at any time.

        It looks like you are claiming about £1000 which I suppose could be done but -are you being made redundant or just your job?

          My role will no longer exist under the new structure so I will be redundant. I'll get 12 weeks pay in lieu of notice plus redundancy. I just want to make sure I claim everything owed to me before I sign anything and leave for good.

              I don't think you are actually entitled to a redundancy payment until you have two years service, so anything that you are getting is beyond your statutory entitlement.

                The OP said it was a new role so maybe with the same company in which case there might be two years service .

                      Something to think about

                      Are the company paying you only statutory redundancy or is it enhanced as some companies do even in this day and age

                      I am guessing that the 6 weeks pay is you contractual notice period

                      If they are paying enhanced you may find that you are biting the hand that feeds you so to speak

                        I'm getting only statutory redundancy, and yes the 12 weeks pay is my contractual notice period.
