  • Advice on SSP and my illness......

    Hi All,

    I am looking for some advice please.....

    In June 2014 I was diagnosed with gallstones however I did plenty of reading and changed my diet whice meant I had no symptoms - however in May 2015 I got a severe infection of my gallbladder and spent 5 days in hospital and 6 weeks off work...

    The idea from the consultant at the time was to remove the gallbladder however they wanted to wait 8 weeks to ensure all the infection had gone to enable them to carry out keyhole surgery without any increased risk...

    I went back to work but had reoccurring gallstone pain and had to take the odd few days off work due to the deliberating pain caused....

    The hospital took longer than 8 weeks to call me in and in the meantime I ended up being admitted to hospital on the 18th August due to a rogue gallstone escaping from my gallbladder and causing a total obstruction of my common bile duct ! I spent over 2 weeks in hospital after a procedure ERCP failed to remove the stone and a stent was placed in the duct to help get my flow of bile moving again, the procedure left me with severe pancreatitis which is a risk of the ERCP procedure....

    I have now a date of 25th Sept for keyhole surgery and a possibility of a retry of the ercp to remove the stone on the 21st september....

    I have received a letter from my employer stating that :

    "As you know, the terms of your employment with us include a provision that, in the event of absence from work due to sickness, you are entitled to continue to receive full basic pay (Occupational sick pay) for a period (which may be linked) of 16 weeks".

    It goes on to say that SSP is payable for upto 28 weeks in any one (or linked) period(s) of sickness absence, however this is inclusive of the period of occupational sick pay and not in addition to, ie an employee with 1 week OSP entitlement may be entitled to SSP to a maximum of 27 weeks.

    Your current period of sickness began on 11th August 2015. This means that your entitlement to OSP will come to an end on 25th September taking into account absence over previous 12 months.


    My questions are:
    Is there any way that i can contest this as the delay is down to the hospital and i should be fully fit by mid-end October so only 4 weeks after SSP starts??
    I presume it is too late to take out sickness insurance??

    Any assistance would be appreciated
