  • 'Band of Reasonable Responses' - how is this worked out?

    I know there are questions an ET must ask with regard to the 'Band of reasonable Responses', but how do they know what a reasonable employer would actually do? If your employer breached their own disciplinary procedures or ACAS guidance, does that put any decision they make as a result of the breach outside the band of reasonable response?

      If they breach there own policy or fail to follow ACAS guidelines, then depending on the seriousness of the breach it would bring into question whether they acted reasonable and indeed fairly. So yes it does have an effect on whether they are deemed to have acted reasonably or unreasonably and therefore could also be the difference between whether the dismissal was fair or unfair dismissal!

        A court ruled that using a previous warning issued in bad faith is not acting reasonably and any dismissal will be unfair. If you can prove within the first 5 minutes of the tribunal that a previous warning was issued in bad faith and that warning was then used to dismiss you, would the tribunal carry on or would it stop because you have proved unfair dismissal?

          The tribunal would carry on to hear all facts, statements and see all evidence regardless. However if such a warning given in bad faith previously made the difference then it would find it was unfair dismissal on that point alone, but before doing so it would have to take into account everything else as well. So no a tribunal simply would not stop just because it has heard they did such a thing.
