  • Minutes of the disciplinary

    At my Disciplinary Hearing I read out prepared notes and handed copies of them over to the Minute taker. If the Minutes of the hearing supplied to me do not include the notes I read out, are those Minutes complete? My notes are referred to in the Minutes as 'Doc 1 read out', 'Doc 2 read out' etc, but those 'Docs' were not included with the Minutes I got.

    As they have referred to them as doc 1 "read out", doc 2 read out. then its clear in the minutes that the documents where read out. So they don't need to write them down in the minutes when the content is already written in the documents.

    Also as they were your notes, then why would they need to supply you with copies when you supplied copies to them and presumably still have original copies!

      They don't know that I kept copies of any notes and, they are supposed to supply copies of the Minutes on request. They only supplied their half of the Minutes which IMO makes them incomplete. I'm not so much concerned about what I received. I'm more concerned about if they send incomplete Minutes to the tribunal. I wont know that until I get the bundle, which knowing my employer will be last minute and too late to do anything about it.

          The minutes should contain everything that is said by everyone, not just what is said by them. But they do not have to write word for word what was contained in the notes that were read out aloud and then handed to them. They only have to state, just like they did, that doc 1, doc 2 were read out.

          Did you sign the minutes at the end of the meeting to confirm they were accurate? If not then you should write to the employer disputing the minutes they sent to you and explain why you dispute them, i.e. half of what was said is not included.

          If your only disputing the minutes purely because what was read out aloud from your notes (that you handed them copies of) was not included, then you have nothing to dispute! As they clearly reference them notes as being read out aloud!

              Has the tribunal not given orders, giving dates for the bundle to be completed by and the disclosure of documents ?

                Has the OP issued a claim? There are other threads where questions were asked but no clear indication of a claim being issued. :confused2:

                These days you have three months to start ACAS early conciliation which can get you an extra month to issue your claim but still three months to start the ball rolling if a claim hasn't yet been issued.

                  Have to agree with you there [MENTION=37786]FlamingParrot[/MENTION] - I have seen other threads too.

                  Its actually annoying as clearly from the questions being asked they need help, yet may or may not have issued a claim, if they have they clearly are not sure as to what employer can and can not do etc - Along with not being sure on other things.

                  Its always best to get advice and help first before issuing a claim, if your not sure of employment law or employment rights!

                    Don't mean to come across as annoying. Once I have the answer to my question I move on.

                    Yes I have issued a claim. I'm still not sure of certain things. The things I'm not sure of I will ask a question about when they crop up.

                      No ones actually saying you yourself are annoying, we're just talking in general (though having looked back at my last post i can see how it does sound like i'm talking about you as being annoying - But it wasn't meant to be directed directly at you) about how people come to this forum when they have already issued a claim and seek advice on things. A lot do not even bother to return or say thank you, where as at least you have.

                      Though it would be more beneficial to you if we knew some details, as its hard to answer some questions without knowing certain details of what the claim is!

                      Maybe start a thread specific to your claim where you can then post your questions to it, that way anyone advising will be able to look back through the same thread to get a basic understanding of what your claim is about etc - Basically safes you and us from a lot of confusion too!

                              As suspected the stuff I read out has not been included with the minutes in the bundle and just saying doc1 and doc2 doesn't cover anything I said. Now the tribunal will only be reading what they said. My solicitor doesn't see this as a big deal because he is convinced we will win without them and is just going to mention at the hearing that the minutes are not complete and leave it at that.

                              I do see it as a big deal even though we have a strong case because I don't want to leave anything to chance and it doesn't help that I need to refer to them in my statement. Is there anything I can do to get the bundle changed or am I stuck with it as it is?
