However he agreed that as my medical history was irrelevant they have broken the disciplinary process and have even discriminated against me by not taking my condition seriously. Although he agrees they will not reinstate me he's pretty certain they will at least pay me off or I'll be awarded compensation.

Please please don't let this debate get any more heated. I'm under no illusion that what I've done is incredibly bad but I deeply regret it and will never make this mistake again. I'm seeking professional help to find out why I stole and my doctor is doing some tests to find out my mental health state. He's also writing a letter to work to support my claims that liver disease can have terrible effects on a person's actions. My liver disease specialist is also going to write to work in great detail which will be in my favour.

The moral of the story is do not steal. It's not worth it. At the end of the day everything happens for a reason and maybe the outcome will have a positive ending for me.

Thanks for all your comments and taking the time to reply.
Its good to see you are realising what has been done is done and are seeking help when this is all over with your Employer time to get back to getting yourself sorted its obvious you want help its out there and you seem positive enough to use it and get back your life.

The arguments on here are not personal attacks on you they are more general one thing im sure all of us want is YOU to get sorted you admit what you did was wrong there are mitigating circumstances whether they will be accepted or not is a big question .

Other Beagles on here will offer the best help and advice around as this progresses don't hesitate to come back we all want you and everyone who comes on LB to receive the help you deserve you will get through this be Positive

I do not think anyone has been judging you just differing opinions on how to handle it . It would be nice to believe that employers were kind and caring but IMO that is bull, employers are there to make the biggest profit by exploiting their employees. The only reason they appear to bend over backwards to help is because it could cost them more if they have legal disputes to settle when they pay lawyers many times more than you or I would. I remember being told that a certain fast food company paid their lawyers over 1K per hour and that was 20 years ago when I worked for them .
If you live in a bigger city you may find that there are community law centres or such so they may also be able to give advice.

On another note , if you do apply for ESA (and I would if your GP will sign you off) get some help from CAB or a welfare expert in filling in the form . If you need `ny pointers on that I think Kati of the site team can point you in a good direction or PM me if its a bit personal- you know enough about me lol

As stated in other posts, it would be irresponsible to encourage you (or anyone else in a similar situation) to make an ET claim without warning about potential consequences. Whilst I'm not a lawyer, my understanding is that in a case like this there's a realistic chance of costs being awarded.

Trying to justify to yourself your actions is a normal reaction. However, I for one believe that this has nothing whatsoever to do with your medication or illness!

I remember someone who got a Ł4k settlement from the fast food outfit, probably because that amount would only cover four hours' worth of shyster time. For that reason, larger companies are more likely to offer settlements as they are also more likely to hire expensive lawyers than little two bit cowboy outfits who tend to be more reluctant to settle. :ohwell:

Yes, there are a few although these days you can just google and make the initial contact by email, then have chats over the phone.

Knowing what the DWP are like, it may be easier to claim ESA if you have a history of illness affecting your ability to work. For JSA they may want to sanction for a period of time if they consider dismissal for GM as not being involuntarily unemployed.

ESA would be the best route.

Flaming Parrot is spot on: DWP (aka the Social) won't like someone who caused their own dismissal!

Any medical evidence with ESA should help.

The OP would need to get his doctor to sign him off in order to claim ESA.

Yes, and in view of all the above it shouldn't be that difficult. You often get signed off for stress after being dismissed even when you didn't have a medical history. In this case the stress of being dismissed could only compound the health issues that were already affecting him. :mmph:

That is true is that, being dismissed can result in people becoming depressed and be stressful for them, especially from a financial aspect!
