  • help advice training costs please help

    hi was wondering if anyone could please help me!!

    First of please don't judge, about 8 weeks ago my partner was being blackmailed by a fellow work collegue (basically they took something they shouldn't have, had a falling, out collegue threatened to tell boss so my partner owned up, didn't want to be held to ransom basically by someone) Anyways that was that employer wasn't happy of course then about 5 weeks ago realised there was a £20 deduction in wages as stated on pay slip questioned what this was for the employer stated to repay for the said items ,seemed fair enough but didn't realise he'd been deduction the said £20 for 3 weeks without telling us but thought it was only right to repay the said amount. The other guy was also having deduction took out even though he denied having any involvement ( even though he did) . So my first question is even though we feel its right to pay back the employer should he not have informed us of this in writing before making deductions?

    Then last week my partner was asked more about said theft said he'd told the employer everything he had to tell him, he couldn't tell him anymore because he'd already told him everything (think the employer thought there was more actually taken than admitted to but really there wasn't) not happy with the answer he told my partner to hand over all the work possesions phone van etc and to get off the premises when my partner asked are you sacking me he never got a answer. He came home luckily found another job a couple of days later ,then came payday nothing not a penny (wages for work worked the week before) next day invoice came saying all wages and incurred holiday pay had be kept to pay for training courses and that x amount was still owed plus potential money owed said theft.

    Now my question is if my partner was sacked is he liable to pay for training courses? some where 3 years ago, it does state in his contract that training cost may have to repayed but doesn't state how long after they after to stay in employment with the company(if you understand what i'm trying to say) Even tho my partner started at the company in 2012 he signed this employment contract in aug 2014 so probably a long shot I was thinking is the contract regarding any training costs repayments only viable from last year? and that any training courses taken before this date not included? thank you for reading and please any help would be really helpful.

    Also they man still has his job.

        Can you post up a copy of his employment contract or if the training fees were on a separate documents he signed can you post up a copy of that too please. Generally if your dismissed they do not take back training fees.

        As your partner was clearly dismissed without notice, or any form of disciplinary process, then its unfair dismissal (if hes been their 2years or more), either-way dismissal without notice, means the employer would owe him pay for the notice period as dismissal without notice is also a breach of contract by the employer, so notice pay in lieu is deemed a compensatory payment (Not taxable too)!

        As for the deductions, well, we need more info from the employer as per the additional allegation of theft, as we haven't got that, then all hes entitled to withhold is the monetary value of the first theft, which you already have said your willing to pay, even though you didn't as yet consent to it. The rest is an unauthorised deduction, though how much in total depends on what the terms of the training fees are.

        So how long has your partner worked their?

        Don't forget to post up copy of contract, training fee agreement etc - Minus personal and company details!
