• possibly having payment witheld

Hi, can anyone help me with this question. I am a self employed trainer and have marked a vast number of papers for various training courses for the same company. Samples of the marked papers have been taken and have always come back with the response that they are good. Now they are saying that mistakes have been made on the papers. My contract with them states that all work must be carried out to a high standard. I'm now worried that they can withhold payment as they owe me quite a considerable sum.Anyone know if this could happen.

Hi martburr - welcome to the forum.

Of course this could happen; however, if the company does withhold payment I would ask it to justify that action. If the reason is because work was not carried out to a high standard, I would ask for evidence to support that claim. I would also ask why the mistakes were not identified previously, and if they were, why remedial action was not taken and/or why was your contract not terminated sooner.

If they continue to withhold payment I would consider making a court claim.
