  • Urgent help required. 2nd investigation meeting tomorrow. Need advice

    I have been in my current Management role for just over 3 years on 45K pa. On Monday last week, I was given 10 minutes notice that my Manager wanted a chat about two concerns that had been raised while I was on holiday. I was advised that I could bring a representative with me (which I did). Non Union. My Manager outlined two issues that they wanted clarity on and the meeting was minuted by HR. I was told that I was suspended with immediate effect pending investigation of the two issues raised.

    Later that day I was given a copy of the meeting minutes and a letter stating that I had knowingly entered incorrect information onto a database and that I had incorrectly advised Senior Management on the closure of open actions that had a detrimental effect on a recent Corporate audit.

    I was invited to come in to work the following day for two hours to gather evidence from previous emails to support my actions. I was not given access to any servers or database but could request documents. I was asked if I could attend a meeting with another Senior manager and HR the following day. which I did (with same representative).

    I prepared for the meeting and felt I gave honest factual evidence to refute the two claims. I heard nothing more until yesterday when I was called and asked to attend a follow up investigation meeting. I asked for a copy of the previous meeting minutes (over a week ago) as I have not had a chance to agree or dispute the minutes and was informed that I will see them when I attend tomorrow.

    I believe that I am the fall guy for the under performance of a Corporate audit that occurred over a month ago. My department has been significantly under resourced due to sickness and there is a culture of bullying and fear within the organisation which has made it very difficult to reach out for support/help.

    I believe the company want me out (as do I), however i need to leave with the best package possible to allow me to have time to find the next role (I am in my mid 50's).

    I believe there are several ways this can go but feel the most likely are:

    1. Forced to resign to avoid disciplinary action and effectively put me on garden leave for 3 months.
    2. Offered a compromise agreement (which I am hoping for) as trust between parties has been breached

    I am asking for advice on the best responses to these two options ( I know there are other options so feel free to explain). How best can I turn this into a positive outcome?

    I am currently suffering from stress and anxiety and any assistance would be greatly appreciated

      Did you knowingly enter incorrect data - Can you give us bit more info as to what they alleged you did! As at the moment we don't have a lot of info to go on really.

      Personally if this is a complicated case as it sounds like it could well be, i would suggest you seek advise from a solicitor who specializes in employment law.
