Re: Pregnant and made redundant - HELP
Further to my last post, please find copies of the notes I have made for my OH so far for her meeting, and a letter to request personnel file.
The comments in red text I wanted to check were OK to mention or ask during the grievance meeting?
Thank you

Re: Pregnant and made redundant - HELP
Evening matt3942 and thanks for the advice.
teaboy2 is there anything else you can add to help?
I have got a letter ready to be handed over at the meeting to obtain my OH's personnel file via a subject access request under the Data Protection Act 1998 c.29 Part II Section 7.
I have tomorrow to get everything set out and straight for my OH to go in and 'discuss' so any help is appreciated.
As far as the meeting goes, we will appeal the outcome so that ACAS can see we have tried and tried with the nursery.

Re: Pregnant and made redundant - HELP
Good morning @RJH - I'm just checking in quickly.
Remember, the grievance meeting is not intended to be a Q&A session. The purpose of the meeting is for your OH to voice her grievance - she needs to iterate the points we've made already in writing, i.e. the contract was intended to be permanent, she was coerced into signing a temporary contract, there was no risk assessment carried out on finding out she was pregnant, she's been made to feel uneasy about taking time off to attend appointments, the timeline of events doesn't support the reasons given for dismissal etc.
@teaboy2 may wish to add more specific pointers - I'll try to check in again later.

matt3942 teaboy2 could you possibly help with a list of questions my OH should be going in to ask? She is worried a little now because she isn't too confident in this kind of situation and would prefer some questions to be written down in front of her that she can then take notes on from the answers she receives.
Thanks,
-Rob

Thanks RJH - I'm pretty sure we covered breach of contract, risk assessment etc. in previous replies.
All the best for Thursday's meeting.

Re: Pregnant and made redundant - HELP
So just to keep you all updated, the meeting is now this Thursday at 09:30 at an alternative venue. Having an off the record chat with a member of my company's HR dept., I'm led to believe even further that the nursery are going to find things difficult as they are in breach of contract amongst other things, like not having a meeting for the change of contract, no consultation, no risk assessment etc.?
I guess Thursday is going to be quite interesting.....

Ok cheers for letting us know, guess the worry of having to attend the meeting too isn't doing her any good either.

matt3942 teaboy2 I have postponed the meeting this morning because she has had a rough night with her back pain etc. so it will be held next week, just waiting on confirming a date. I suppose it will allow more time to prepare what she wants to say too.
Thanks for your advice so far, it's a great help.

Re: Pregnant and made redundant - HELP
I completely agree with teaboy2 - It does seem as though the other owner is more reasonable but we'll wait to find out what happens tomorrow.
All the best.

Re: Pregnant and made redundant - HELP
Just tell her to stick to the facts of the matter from her side of things, and if they ask her to agree to anything tell her to tell them that shes not willing to make any agreements unless the terms of which are put to her in writing for her to then seek further advise on prior to either agreeing or declining!
This is her grievance so its for your other half to get her side across, its not for them to make demands or to put their side across. They will have to take onboard what your OH says and the issues she raises and then investigate them, prior to holding a final grievance hearing with the outcome of their grievance decision! Its also not the place for them to be offering her anything, but if they do, then its a sign the pressure is being felt by them and they are worried! But like i said if they do offer anything for her to agree too, such as a settlement agreement, shes to tell them to put it in writing so she can seek independent advice prior to deciding if she accepts or not!

Re: Pregnant and made redundant - HELP
matt3942 teaboy2 email received back from the owner attached.
One point of interest is that the other owner R, who was initially taking notes, is now no longer attending according to this guy.
I will be going as support tomorrow to sit outside the room.
Can you please give me any advice I can pass on to my OH as to what to say, what not to say, whether she should agree to anything etc.
Thank you.

Re: Pregnant and made redundant - HELP
We have asked that it is postponed as we have made a request for someone else to attend other than work colleagues (due to lack of trust in them) and she isn't a member of a union.
I have the screenshot of proof of signature, so I may just email them and say that you have had our response and the proof is attached.

Re: Pregnant and made redundant - HELP
Okay in the letter you have indicated you may not be able to attend so I really don't think it can hurt to confirm by email that she will be attending so long as everything is okay. No other discussion though - just that she will be attending with x at 10.30 ...

Re: Pregnant and made redundant - HELP
teaboy2 Amethyst I've now checked and both letters are received at both the nursery and the other owners house. What shall I do now? I've got proof they have had the letter on site, before they've phoned my OH. My OH has also just said that the VM she has is the admin girl telling her the owner has told her to phone her to ask about tomorrow.Last edited by RJH; 9th July 2015, 13:26:PM.

Re: Pregnant and made redundant - HELP
Have you emailed the letter to the Nursery ? Might be an idea if they are saying they haven't yet received it.
