          The witness statement probably came from her boyfriend as well with her signature. Explaining all the stress this has put him (I mean her) under.
          Both parties are as guilty as each other and should be warned about this type of conduct and where it could lead, nothing more. It's really got little to do with the company. If it wasn't done on company time or company property. And both were happily exposing themselves by phone to each other before a third party not even connected with the company found out.

            Turns out my boyfriend threw it out after he lost his appeal!! He says he just wants to move on now, I thought I could convince him to seek legal advice if I got advice on here first but he still won't.

            I hate that she is still working there and my boyfriends not able to put his side of the story across and that a career spanning 22 years has been ruined because of this. And that HR have not taken into account some of the points mentioned here, why now etc.

            Thank you all for your advice any way. I have a month and a half left to convince him to do something before the 3 months is up.

              Understand he wants to move on now. Does he have another Job ?

              Did he get any settlement ? or just fired ?

              I am in the same situation. sometimes it can all seem very one sided and unfair when infact it's two sided.

              there is no harm lodging a Early conciliation claim with ACAS EC if you have gone down the appeal process and been dismissed.

                No, he hasn't got another job yet and because what he was doing is quite specialist he is finding it hard which i think is one of he reasons in struggling to let it drop, he dedicated his whole working life to the company, he started when there when he was 16 working in the factory and worked his way up. Some people, including the person who made the decision have known him for over 15 years and know that the incident isn't really in his character, I really believe it was a moment of madness. Anyway he has learnt a very big lesson including that you really are just a number and you have no friends when it comes to business.

                He was just fired, no settlement!

                  All the more reason to seek free advice on a potential unfair dismissal claim.
