  • Finished after potential employer calls employment agency for referance.

A friend of mine has been working for an employment agency for a round 3 months - No problems at all, working when required, coming home no problems doing 32 hrs a week.

The agency had made it clear that was the only amount of hours they were going to give, so my friend started to look at other places of employment to get more hours and make it up to 40+ hrs a week like a proper job.

my friend had an interview with another employer and a week later this other employer asked if it was ok to ask the employment agency for a reference my friend of course agreed why wouldn't they the agency were here current employers.

The very next day my friend received a call from the employment agency after doing a shift saying that they were no longer wanted and all different things ie work performance not good enough over a long period of time etc that they had been told about this on several occasions. (NOBODY HAD EVER SPOKEN TO MY FRIEND IN REGARDS TO THESE THINGS) as i said at the beginning of the post there had never been any problems everybody had been happy.

The other employer told my friend when they attended a second interview they called the agency on that day at 9am and asked for a reference and by 9.20am the employment agency had called me telling me that i was finished.

Is this really what its like to live in a CON-DEM Nation? is there anything my friend can do, can they just treat my friend like a piece of meat?.

    Hello pp.
The employment agency is paid by employers to provide people. There is a healthy mark-up.
When an employer "poaches" someone from the agency and wants to employ them directly, the agency often does what has happened to your friend.
That has been the case for decades, including during the 13 years of "Labour".

Re: Finished after potential employer calls employment agency for referance.

Just to be clear here. Was your friend working as a member of staff for the employment agency itself or as an agency worker that the employment agency sent to work for various employers?

Also was your friend successful in getting the other job, or unsuccessful as a result of the employment agency telling them your friend had been sacked?

If unsuccessful - What precisely did the agency tell the prospective employer as references most be accurate and precise. False information in a reference is libelous, so if they said your friend was sacked for the poor work performances that they said they had spoke to your friend about on many occasions when they had not. Then that would be false information and the reference would be libelous - The employment agency would need proof of poor performance and it being raised as an issue with your friend to prove the reference was accurate. So SAR (Subject access Request) the employment agency for all documentation they hold for your friend, such as employment file, wages slips, contract, emails/notes/letters where your friend is mentioned etc.

If successful - Then your friend should be glad they are not working for the employment agency anymore and look forward to building a career with their new employer.

Thanks for the reply as stated my friend was working for the agency not the factory, they also said they had received an email from the line manager(permanent employee at the factory) that morning complaining about my friends work performance, we have since learnt no such complaint was ever made therefore no email exists.

The line manager knew absolutely nothing about this.

The agency haven't told anybody my freind was sacked, they sacked my friend straight after the other company(not an agency) called asking for a reference which they have to do as its a job working with vulnerable people.

I can confirm my friend has received an offer of employment from the other company relent on the reference and a crb.

I can also confirm that no such reference has been received from the employment agency yet.

And finally i can confirm that as of yesterday my friend has no job/work at all 0 income.

So in an attempt to be a striver and get on in life by getting a few more extra hours to add to the hours they were getting at the employment agency they have been left with nothing.

i ve been racking my brains trying to think what they call it know oh yes i remember UNIVERSAL POVERTY.

We're trying to help you, but you keep reverting to attempts to make political points.
Your friend will be grateful for the 1000 new jobs created every single day that the coalition has been in power.
          Around 2 million new jobs.
Can we now get back to the matter at hand?
Your friend should make a subject access request to the employment agency, in writing.
She wants copies of every single bit of information the agency holds about her.
Every phone call, every letter, every email.
That will reveal whether or not there has been skullduggery.
