Does anyone know how enforceable a mobility clause is? My company is trying to get rid of me by enforcing a mobility clause that I did not agree to. I was Tuped over from a different company twice and have almost 11 years continuous employment. This latest company says that I have agreed to the mobility clause by default. I never agreed or signed a new contract after the first Tupe as it was detrimental to my previous terms but I don't have anything in writing. The stress of this is making me ill , I am due an operation to remove a kidney next month and this is really dragging me down. I don't know what my rights are. Can anyone help?

Re: Mobility Clause related to Tupe
Hi and welcome.
Did your contract contain an express written term allowing your employer to change your contract without further agreement from you?
Did they explain how you are supposed to agreed to this change by default?
Perhaps one of our employment experts will be able to explain.
