    Hi.
    Say someone of legal age, worked for 2 months without a national insurance number. The pay was not worth mentioning (250 pounds) and it was also the only work during that year.

    Say that same persion also did indeed pay the tax, and then when the tax return came, since the income was so low that it was not taxable, he did not even cash in the check, since again the 50 pounds tax was very little. (That person is rather lazy when it comes to things like that).

    Now, assuming that person wanted to get a National Insurance number. How should he proceed? Is there any difficulties that could arise for him or his emplyer, since he worked without a national insurance number?

    The thing is that, there was clearly no intent on tax dogery, since the income was too low and that person didnt even claim a refund, so paid the tax anyways.

    How did the 'said person' pay tax without a NI number?

    In my eyes, working without a NINO would be near enough impossible unless it was cash-in-hand and also "off the books", in which case I believe it would also be illegal (and IMO anyone working like that wouldn't really be bothered about paying tax on the earnings in case they were found out)

      Not sure. The person believes to have gotten a Temporary National Insurance Number. In the HM Revenue & Customs "Request for Information" letter he recieved, there is a "Temp NINO ********". Unfortunatley said person did not pay too much attention to these kinds of things, due to the low amount of money.

      But there is a HM Revenue and Customs letter with the Tax Calculation header as well, which stats that "your personal allowances exceed your taxable income, no tax is due" and a check was attached with the return money, which the person never chashed.

      Interestingly, under National Insurance Number, on the Tax return, the TEMP NINO is given as simply National Insurance Number.
      So could said person have been assigned a temporary national insurance number without his knowledge?

      EDIT: The person was not payed in cash but via bank transfer.

          To be honest I am not sure.

          The person is indeed a migrant, but I am not sure if he is classed as a migrant worker. There is no such term used anywhere he can find. There is a "Pay as you earn" written at one point. But the thing is that he did not come to the country as a migrant worker, but rather as a dependant. This was just done during his studies for a short time. He is unsure what title his employers used when filling out the forms.

          None the less, what should he do now? It was stupid not to get the NI right away, but the person would like to now if any difficulties could arise. Thank you for your answers btw.

            Did he pay the tax personally, or was it deducted from his 'wage packet'?

            Was he a 'minor' dependent?

            You must have the right to work or study in the UK to get a National Insurance number. Jobcentre Plus might ask you to go to an interview to confirm your identity.

            Monday to Friday, 8am to 6pm

            National Insurance number interview

            Jobcentre Plus may write to you and ask you to come to an interview where you’ll be asked about your circumstances and why you need a National Insurance number.
            The letter will also tell you which documents to bring to prove your identity, eg:
            • passport/identity card
            • residence permit
            • birth/adoption certificate
            • marriage/civil partnership certificate
            • driving licence

            You turned 16 and didn't get a number

            You should automatically get a National Insurance number just before your 16th birthday if you live in the UK.

            Call the National Insurance numbers helpline if you didn't get one and you’re under 20.

              It was deducted from his wage, and he was of legal age during that time. He is indeed planning on getting it as soon as possible now, but he also would rather like to make sure that he does things right.

              Edit: He is also rather confused and not sure if he already even has one, since the Tax return does say National Insurance Number and it agrees with the Temp NINo he had earlier. But I am pretty sure thats not really possible, to get a National Insurance number without knowing it.

                OK ... I'd say that if he had a 'temporary' NINO and the tax was taken straight from his wage then it should all be above board and he won't need to worry
                He now needs to apply for a proper NINO through his local Jobcentre (see my post #6 for details).


                Oh ... and I wasn't asking if he was working underage, just if he was a minor (under 16) when he first came to the UK, as he should have automatically got a NINO if that was the case :nod:

                  As to your edit ... when you are notified of your NINO, you don't get a 'card' anymore just a letter. It might be worth him contacting the Jobcentre and asking them if the number he has already is his official NINO

                    No worries, I understood, hence my answer:tinysmile_twink_t2:. The person was underage when he moved to this country (but over 16) as a dependant and then went to school here. But during the time he worked, he was already of legal age, indeed a student. Thats what I meant to say.

                    Well thats good to hear . But if I may ask so, how could he have gotten one without him applying for one?

                      You should automatically receive a NINO around your 16th birthday if you live in the UK - If he didn't receive one (and is still under the age of 20) he should ring the NINO helpline:
                      National Insurance numbers

                      • Telephone: 0300 200 3502
                      • Textphone: 300 200 3519

                      Get advice if:
                      • you’re a young person between 15 years and 9 months and 20 years old and haven’t received a National Insurance number
                      • you’ve lost or can’t remember your National Insurance number
                      • you need a letter of confirmation of your National Insurance number


                      You’ll need to fill in form CA5403 if you can’t answer the questions

                      HMRC cannot allocate National Insurance numbers or arrange appointments with Jobcentre Plus for you to apply for a National Insurance number.
                      If he's over 20, then it's contact the Jobcentre.

                        Thanks again, as I edited, he was over 16.

                        Anyways, I have 1 more question I appologise but I didnt think of it before. He sadly also never filled out the request for information letter he recieved initially, because he didn't have a NINO. The Tax return letter he got was AFTER that where everything seemed all right and again due to the low amount of money and the fact that he had payed his taxes, he kind of forgot about it and its over a year now. Can that cause a problem? I mean they of course had his name (its on the form as well as the tax return) and his adress etc, so the only thing that actually needed to be filled in was the NINO and since the person did not have it at that time (to his knowledge) he did not fill it out.

                          I'd still say that the best thing for him to do is ask (either through the NINO helpline if he's under 20 or through the Jobcentre if he's older). If he explains why he didn't send back the form (no NINO at the time etc...) then I cannot see it being a problem (IMO)
