  • Query about overtime, contracted hours and holiday entitlement.

Hi, this is my first post on the forums and I am looking for some advice. I currently work for a security company on a 42 Hour/week contract. In September 2014 I changed roles within the business and now work 60 hours/week (12 hours of which are voluntary) as my new role requires me to work 4x12 hour shifts per week . However, when I booked my holiday for December for a week I was only given 42 hours holiday as per my contract of employment. In effect, by going on holiday I lose at least 6 hours pay per week (18 with the voluntary overtime). Surely this is unfair? I have read on these forums that there has been changes to holiday entitlement where overtime is concerned, and I am looking at the best way to proceed. As I foresee myself working 60 hours a week for the next few years can I insist that my employer changes my contract to 48 hours a week or 60 to reflect my actual work pattern? Many thanks in advance.

Yes you are entitled to 60 hours holiday pay per weeks holiday. Point your employer to the following article on Acas website - http://www.acas.org.uk/index.aspx?articleid=4520
