      Hi again,

      it all started when I got locked up for drink driving. I blew 52mg. I was kept in custody for 13hrs and my house was illegally searched. I had moved a car 4 feet at the behest of Police which a visitor to my house had parked in a dangerous position outside of my house where I had been all night. This was 2am and I had not drunk since 12ish so thought I was sorting the problem out. From that moment on, my life was not worth living. It became worse when I went to court and the court saw it for what it was and I was given an absolute discharge. Things became worse after that. I obviously had a discipline hearing but the bosses are so stupid at times. I requested a freedom of info on all emails from certain people where my name was mentioned. It was obvious from these emails that my days were numbered. I had no problem being punished for my own stupidity but the hearing was a farce and carried out by one of my managers who basically said 'guilty'. I appealed and got a written warning from another senior officer from another district. I eventually sued the Police for unlawful search of my house and for keeping me in custody so long. They settled before going to court. I certainly think I was stupid for moving the car but did not think I was over the limit..it's something I will regret the rest of my life.

        It sounds like you have been the victim of target-driven policing, Andy. One thing I have noticed about target-driven policing is that it encourages otherwise reputable officers to wind-up people to make them kick-off and justify making an arrest and issuing FPNs in total contravention of Article 6, Human Rights Act 1998.

        The way the disciplinary issues were dealt with seem somewhat out of kilter. In the force I was with before injury ended my career, a senior officer from another area would investigate, a report would be sent to the ACC responsible for Complaints and Discipline (now Professional Standards) and if there was a case to answer, a Chief Superintendent or ACC from another area would hold a disciplinary hearing.

        Was it Uniform or Traffic (now Roads Policing) who told you to move the car?

          In the UK (except, from today, for Scotland) the limit is 80mg. So @52mg you would have been well within the legal limit for driving.

            it appears their objection to matters of the ET being raised at the hearing has been submitted too late. They have seen the evidence I was submitting some time ago and they have to object at least 7 days before the hearing. They objected yesterday and the hearing is next Wednesday. Onwards and upwards.               thanks for replying. I am probably getting the mg's mixed up. I blew 52 in breath and the limit is 35 here in England although we do not prosecute if below 40, I think 80 is blood. Long time since I was a custody sgt. Like the pic!

                just lads from uniform. I have no problems with what they did. A certain sgt who wanted a cops scalp ensured I was locked up. My fault for moving it..I could have given the cops the keys but I thought I was ok. I had no problem getting disciplined but it was done all wrong. It was my subsequent treatment that caused many problems. All in the past now..just want this pension sorted out. Hopefully in my favour. It's also going to come down to the medical evidence.

                      Well guys..for those that are interested. The chair at the hearing basically said a pension appeal is not the place to discuss the breaching of a COT3 and if the force wish to pursue that, then crack on but not here. Once I brought this evidence in I am hoping the panel realised why the police didn't want it in!

                        Sounds like the Chair is not interested in their allegations that your in breach of COT3, which your not. So looks like you should get your pension!
