  • Job advertisement

Is it illegal for a company to advertise a vacancy that has been filled. The job in question was taken on the 19th May 2014 internally but the company advertised the job on the 27th May then removing it from their website on 12th June 2014.

    Re: Job advertisement

Nope, its not illegal to advertise any job vacancy (well so long as its not advertising illegal services etc). Its only unlawful to advertise a vacancy for a position where last person filled it was made redundant just prior to advertising - But that's only because its actually the position that's made redundant not the person themselves, as the person simply becomes surplus to requirements where no work can be offered to them.

Whats likely happened is a lack of communication between the persons in HR who deal with recruitment and who deal with placing adverts for job vacancy, resulting in person placing advert not knowing the vacancy had been filled. Or maybe they were looking for more than one person for the same role, not all positions are in a company are filled by just one person. i.e. you could have ten supervisors, 100 account managers or 1,000 factory operatives!
