  • Overtime and holiday pay

    Hi

I have recently heard in the media that overtime should be counted towards calculating holiday entitlement.

If this new rule/legislation comes into affect 100% would it be stupid to think employers will back date any extra holidays I should have been entitled to? If so how far back do you think they would back date by?

    Regards

    Re: Overtime and holiday pay

    Hi Steven

As this is as yet still in consultation stage I cannot give you any definitive answers I'm afraid. However, as this would cost businesses quite a lot of money, which is one of their objections, I do doubt that it would be backdated. If they did that would have significant consequences to any business' finances and may even cause some to close.

Fairy muff, I would wait to see what is decided first though before steaming into your employer, also don't forget this is voluntary overtime

In my contract it states 'you will be required to work additional hours as required by your line manager'

as it says I am "required" to do overtime I'm assuming id be eligible for extra holidays if the ruling is put in place fully?

I really couldn't answer that with confidence until more has been looked at by those consulting on it.
