Hi all,
The company I work for requires me to serve 3 months notice before starting a new job. I signed this contract about 5 years ago when the company was having a reshuffle. Obviously at the time, if I did not sign the contract, I would have lost my job.
I have been employed by this company for 16 years. I have no desire to be unfair to them, but realistically, how many new potential employers are going to be prepared to wait 3 months before I can begin? I feel like I am somewhat trapped by the terms of my contract.
My contract states that if I do not work my full notice I can have money "deducted from any termination pay due to me". If a potential employer wants me to start work in 6 weeks, then I have no choice but to break my contractual terms with my current employer. Does this mean they can deduct from my wages money that I have earned whilst working for them. What exactly is termination pay? Does this simply refer to the final pay cheque? If so, does my employer really have the right to not pay me for the time I have worked?
I would very much appreciate any clarification you might be able to give.
