  • Bonus?

    Hi,

    I have an issue regarding my bonus and my notice period as listed below. I have tried to put all the details in there, its a bit of a read, but hopefully someone can help me with the questions below. Thank you.

    I have worked for my currant company/team for the last 4 years (season). I am now working my notice period

    In pervious years a bonus was awarded per point the team received per race and paid into your monthly salary. This year it has changed and a bonus is awarded on the overall standings at the end of the season and only paid on January 31st.

    My contract, which I signed when I started, states "Notice to be given by employee - not less than one months notice in writing, such notice to expire only during the period between the last race of the season and 31st december of that year". "Any additional benefits such as bonuses provided to you to assist you or motivate you in permanence of your duties are provided on an entirely discretionary basis and may be withdrawn at any time without notice."

    The last race of the year is normal the end of November, which means you basically can only leave in December. There is around 50 people on this type of contract, basically the ones who travel with the team, anyone based at the HQ is on a more normal 1 or 3 month notice period served at any time.

    My bonus letter for this year states "the scheme applies to employees working on the programme, provided in each case that the employee is

    * in employment at the date on which the bonus payment is made
    * has not tendered his/her notice by such date.

    With the above in mind, I spoke to my Line Manager, saying that I was going to be unable to travel with the team next year and would need to leave at the end of the season. I was verbally told, seeing as I gave him over 4 months notice of my intent to leave and the fact I was staying till after the season finished my bonus would be honoured to me. He offered this to me, rather than me asking for it. I also asked via email for him to give me written confirmation of which I received this reply.

    Please below in Red which are the answer I can give you now. Circumstances may change which may mean that the answers I have communicated below will also change. More information will be available once I receive your letter of resignation and I have spoken with several people.

    * Bonus (assuming we finish in the top 6) will be honoured due to the extended notice I have given.

    It would be reasonable to conclude that if you continue to work as you have been up until your leaving date (dependant on when this is), with the objective of the team finishing as high as possible in the constructors championship, then you would also receive the bonus in recognition of that fact

    After I received this email, I handed in my written notice, stating I wished for my bonus to be honoured following my conversation with my line manager. HR replied to me stating

    I note in your letter of resignation that you refer to the bonus, and ask that your line manager honours his commitment to you to make payment of it. Unfortunately payment of the bonus is not within you line managers gift, and that you will not be eligible to receive any bonus for the remainder of the 2014 season.

    My question is basically, what can I do to still get my bonus.

    I was told I could have it and then that was retracted after I had made my notice official. Was that simply an incentive for me to hand my notice in early, a carrot?

    If I was to stay until the bonus is paid I would then be into the 2015 season and therefore would need to work almost another complete year. My only option would be to walk after receiving my bonus, although this is not very professional.

    The bonus is looking like it would be around a whole months salary, so not something to just let go without trying something.

    Hi,
    Unfortunately it looks like your 'bonus' is in doubt due to what you have said.........
    "Any additional benefits such as bonuses provided to you to assist you or motivate you in permanence of your duties are provided on an entirely discretionary basis and may be withdrawn at any time without notice."
    So it looks like your company can just withdraw the bonus as per contract........
