  • no share of tips during probation legal?

Hi all I'm fresh out of uni and just started a job at a restaurant chain, while I look for something more permanent. I have been there about 2 weeks now and since then me and the other new starters have been told we are not allowed a share of the tips (which are joined together and shared out daily) until we have passed our probationary period. I was wondering if this was legal for them to do, as it is a lot of money we seem to be losing out on.
    Thanks

    Hi,
I can't answer your question as to the legality of what's happening, I would ask did they give a reason as to why you were not getting a share?

It would depend entirely what your contract says, sorry.

Having looked at your contract you might find this link useful: http://www.hmrc.gov.uk/manuals/nimmanual/nim02941.htm
