    Hi. Having found your forum recently It seems I'm forever needing help.
    I am currently trying to get to an Employment tribunal. The short version. Got to the stage of ACAS etc. Spoke to a Solicitor said possible Discrimination Case, Sent them all the papers etc. Now I feel their stalling and am expecting the news that I will have pay up front for their services as well as the Tribunal costs or alternatively go it on my own either way I will have to pay the tribunal costs. Needless to say I am not in the financial position to either of these. I have less that 5 days to file including this this w'end. I can imagine the questions. Advice would be greatly appreciated or the name of a genuine Lawyer. My thanks and gratitude in advance.

      Hi,
      First I need to know details of the case, and whether there is foundation to your claim for discrimination.
      You may believe that you have been dismissed because of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex or sexual orientation. You can make a claim for discrimination to an employment tribunal instead of, or in addition to, a claim for unfair dismissal. You do not have to have worked for any particular length of time to be able to claim discrimination.
      The Tribunal award costs, these are usually made against the employer, this applies to more than 95% of cases.
      A tribunal will only award costs against the employee, if the case that you bring, has no foundation, is frivolously disrespectful, shallow, or lacking in seriousness. Or has no chance of success.
      So if you have been discriminated on by any of the above points, and you have proof, then you have a case for Tribunal.
      But I need more information from you.

        Firstly, to Kati Thanks for you link have sent an email and awaiting response.

        007 .. Hi, I have always been a private person and this is my first venture into forums etc., so am a bit reluctant to put too much info on here, please excuse my paranoia. Have been told that I have a case for unfair dismissal on the grounds of 1) duty of care. 2) racial/direct and indirect discrimination and possibly being outspoken on issues on breach of the care and welfare of others. In their rush to get rid of me the company breached several of their policies and procedures. by failure to supply evidence to prepare for a defence, refusing to allow an extension to prepare a defence. Not sending information requested in SAR to support a claim. The evidence is there but the company has this information but wont release it. TICO says they cant force them to release it. The company feels they are safe because without it I can,t purse any further action, hence the SAR. The problem is getting an ET hearing for this evidence to come out. This is where the Solicitors baulk and I cant afford to action.

          Hi,
          Well you will need evidence to take a claim to a tribunal.
          If information is sensitive you can always send it by 'private message', instead of posting it on open forum.
          You cannot claim unfair dismissal unless you have worked in a company for two years or more.
          As already stated, discrimination has no time limits.
          If you can prove discrimination, and not just on hearsay, then you can go to a tribunal and claim both.
          Can you let me know what information you have requested in your SAR, and when the time limit for supplying this runs out.
