  • [UK] Is this a fair amount of annual leave?

    I work full time (37.5 hour per week) and started in the first week of April, so my A/L runs from April to April.

    They told me I get 27 days A/L (I thought legally it was 28 days but anyway).

    They've also told me any bank holiday and any time the business is closed must be included.

    There are 8 bank holidays between April 2014 and April 2015. This leaves me with 19 days A/L.

    Then, we break up for Christmas on Friday 22nd December and come back on Monday 5th January. There are 7 closed business days (not including bank holidays, they were included in the 8 days above) during that period, so that leaves me with 12 days A/L.

    Is 12 days A/L that I get to use personally normal, or is the company I work for being a bit unfair?

    I do not know what the legal standing is but normal holidays are 20 -25 days plus bank holidays. The employer usually insists you keep 3-5 for the Christmas break. I am sure someone will be along soon to give you more ‘informed’ info.

      Are you counting the all the days and not just working days. 12 days left would give me two weeks holiday plus two days spare.

      Mon - Fri = 5 days - Sat and Sun as they are not normal working days so do not count.

        This is based on a 5 day working week. Monday to Friday.

          The holiday entitlement will be 28 days a year which can include Bank holidays

            i would check your contract i started current job in June.

            but my A/L runs from 1st of Jan to 31 December
            some employers will not not let you carry over any days that
            are outstanding and you may lose them if not taken.

            so you need to take your A/L before their cut off date.:nod:

              My contract states:

              "In addition to your holiday entitlement you may take and be paid for the bank/public holidays each year."

              Does that mean I have to use my A/L for them or not?

                If it says in addition I would assume that these are separate (not 100% sure tho'). The wording you have quoted (in my opinion) would mean that bank/public holidays are not counted towards your annual leave and you are entitled to take these days off as well as your AL.

                  Just had a root through my husband’s work contract. His states holiday entitlement is 25 days plus bank holidays. He does not use up any of his a/l days for bank holidays but he does have to keep 5 days from his a/l of 25 days for Christmas to cover the days that are not bank holidays but the company is shut down. This means he has 20 days to do what he wants with –or should I say do what I want with!!!!(Gardening, clearing out the garage…..):lol:

                      1. Entitlement
                      Almost all workers are legally entitled to 5.6 weeks’ paid holiday per year (known as statutory leave entitlement or annual leave). An employer can include bank holidays as part of statutory annual leave.
                      Self-employed workers aren’t entitled to annual leave.
                      Working 5 days a week
                      Most workers who work a 5-day week must receive 28 days’ paid annual leave per year. This is calculated by multiplying a normal week (5 days) by the annual entitlement of 5.6 weeks.
                      Working part-time
                      Part-time workers are also entitled to a minimum of 5.6 weeks of paid holiday each year, although this may amount to fewer actual days of paid holiday than a full-time worker would get.
                      Example
                      A worker works 3 days a week. Their leave is calculated by multiplying 3 by 5.6, which comes to 16.8 days of annual paid leave.
                      Limits on statutory leave

                      Statutory paid holiday entitlement is limited to 28 days. Staff working 6 days a week are only entitled to 28 days’ paid holiday and not 33.6 days (5.6 multiplied by 6).
                      If a bank holiday is on a weekend, a ‘substitute’ weekday becomes a bank holiday, normally the following Monday.
                      Your employer doesn’t have to give you paid leave on bank or public holidays.

                      A company can include Bank holidays as part of your statutory holidays.
                      However, if you have a contract that states that you will get paid for Bank Holidays, as well as your statutory holidays, then that is what they must pay you.
                      Not to do so, would be a breach of contract.
                      Likewise, changing the contract without your express agreement, would also be a breach of contract.

                        Closed business days should not be counted unless they are Bank holidays.........:tinysmile_grin_t:

                          My contract is similar here ie bank holidays plus days of which some have to be kept for Christmas.
                          In my other job I have 28 days inclusive of bank holidays and days when the place is shutdown.


                          Mr Mustard, does your contract states any amount of actual days on holiday and furthermore do you have it in writing that you have 27 days holiday? If it's in writing then that is something that we can work on.
                          You also stated that you started in the first week of April so could it be that one day was taken off due to not starting on the first of the month?

                          Johnboy, the government website says "most workers". Are there exceptions and what are they so that we can clarify that no exception of any kind applies in this case?
                          Furthermore, I am assuming your holiday is April to March inclusive, ie 12 months.

                            Shift workers need to use the government pay calculator link on post #11 to calculate their hours etc.

                            And my holiday is from Jan 1st to Dec 31st..... I'm retired.....
