    Hi

    Does anybody know if there is a time limit attached to registering an Employment Tribunal Judgment with the Civil Courts?

    Also, if a person has a Judgment against a partnership (not a company, just partners trading under a certain name), but the partners have gone their separate ways, I presume each of the partners would still be personally liable for a percentage of the sum awarded under Judgment (e.g. 4 partners liable for 25% each)? If this is the case, how should the application to register the Judgment be completed?

      Hi Thomas and welcome to LB.

      I am sorry it has taken two days to pick up on your enquiry.

      The answer to your question is that where a business is run by a partnership and it is an unincorporated partnership, that is, it has not been registered at Companies House as an Incorporated or Limited Liability Partnership (LLP), the partners are jointly and severally liable for all and any debts, including judgements against the partnership by a court or other legally-convened tribunal, including an Employment Tribunal.

      And, yes, you need to register the ET adjudication with the County Court. In what sum is the adjudication?

        If you need to some good advice then talk to a High Court Enforcement Officer as they can enforce any Employment Tribunal award regardless of size. Someone like The Sheriff's Office for example.

          Hi

          Thanks for your advice and assistance with this.

          It is only a small sum of money due to me (just short of £400 without interest), but the sum represents wages owed to me that I worked very hard for.

          The only thing I'm still unsure about is if there is a time limit for lodging the Judgment with the Courts? I've tried doing Google searches, but nothing seems to come up......Maybe I'm missing something? Would it be 6 years from the date of Judgment, just like bringing a claim for money within 6 years of when it was due?

            Get in touch with your local county court and ask them about any time-limit for registering the ET adjudication. That is the most important thing and it would be wise to make enquiries today. Have the date the adjudication was made and the ET reference if you have been given one to quote if asked. If my memory serves me correctly, you can download the requisite form to register the adjudication with the county court from the Ministry of Justice website.
