  • Job description change

    I have been presented a new job description , 90% of job has been changed. I have effectually have been demoted. I Do not want accept the new job description.
    What option do I have ?

    Businesses and organisations can restructure and reorganise to meet changing business conditions, peoples job descriptions can be changed to accomodate this.

    How long have you worked there? Less than two years and there won't be a lot you can do as you do not have the employment protection rights yet.
    How substantial are the changes? 90% doesn't give enough information for people to help you
    Are your pay and other benefits remaining the same?
    Is your previous role disappearing as this could mean that you should have been put at risk of redundancy

      about 12 years , pay other stuff the same ,Yes Its a new job title as well, role is changing form a web based one to technical support.

        Job description/title is a core term of an employment contract - They can not simply change you form, for example, website developer to IT technical support. You can refuse such changes by putting in writing that you do not agree to the changes in your contract or new role nor have you consented to it. Reminding them that Job description is a core term of your employment and if previous role is being made redundant they must offer your redundancy as well as offering you the new role, so you may choose.

        If however the roles are the same, but just different description/title, then you'd be better of accepting, as all they have done is given the role a new description/title rather than changed your role!

        So first you need to ask them exactly what changes to your role are being made, and whether your actually going to be doing the same job as before or not? And make sure you get it in writing from them too!

        If the role is completely different, then they, by the sounds of things, have made your previous role redundant. As such they should offer you redundancy or the new position rather than just changing your contract. If you accept the new position then you accept the new contract. You will not lose your redundancy earnings for the 12 years you have worked previously either as it will continue to accumulate because your will be deemed to have been continuously employed by the company. If you refuse the new role, then they will have to pay you your redundancy package for the 12 years you have worked for them.
