    Hi

    I am facing a disciplinary hearing in a few weeks and included in the pack are 2 issues I have concerns over.

    1 is a case note dating back to 2009 and was a complaint about me raised to a manager after I raised my voice at him in the office, which was never taken any further.

    Another dates to 2011 where I sent a text message in error to my boss, rather than to my partner when I was frustrated about my bosses dithering behaviour. Again although I met with him and HR about the matter, no action was taken on it.

    Neither issue was ever mentioned in any appraisal or 121 from what I recall.

    Firstly should they still have this information on my file? - especially since no action was taken in either case and the dates and secondly can they put it in the pack to support any claims - again as no action was taken. It seems very clutching at straws but it has me upset and annoyed.

    No one previously knew about these incidents other than my boss and I who has now left and I am upset that the investigating officer has now seen them as well as my new boss since no action was taken in either case and even if they prove to be inadmissible, the damage is done.

    If not immediately relevant to the matter in hand, it would appear to be a breach of the Data Protection Act 1998.

      They are using historic issues to taint you that if felt to be of concern should have been dealt with at the time. Ask them why they appear to be trawling for dirt on you?
