  • Continuous Service or Redundancy Payout?

    Hi all.

    My post has been made redundant, and I finish work on 25th April. Luckily, I have found employment elsewhere.

    However, I have two options. (1) I can start my new position with another employer, and take across my continuous service (due to redundancy modification order) and NOT have redundancy payout. Or, (2), I take my redundancy payout and commence work at my new employer after one month has passed, I would NOT be able to take continuous service.

    Which is most beneficial to have? After a dreadful 6 months, the payout sounds nice.

    However, I have previous been told by ACAS (until a repeat call gave them more info), and UNISON, that because the new position starts after my termination date, I should be able to leave on the 25th with redundancy, and start my new position straight away.

    Any advice would be most gratefully accepted. If you need any further info, don't hesitate to ask.

    personally I would take option 2, because if you take option 1, and they go into administration, will you still get what you are owed??
