  • Maternity pay and holiday pay entitlement

    Hi everyone, I have started my maternity leave today. I put in a request for my holiday pay to be put through with my wages which were due to paid yesterday. My employer is a carer for her mother, she gets direct payments to pay me and is therefore paying my maternity pay. I have already looked up and given her the information on how to apply for an advanced payment for my maternity pay. She is saying that she is unable to pay my holiday until the tax office pays her my holiday but my question is would hmrc cover my holiday entitlement? Surely they will only pay her my smp?
    Can she refuse to pay my holiday if they don't pay it to her? She has £4000 in her direct payment account and receives fortnightly cheques which cover the wages so the. £4000 is for holiday, tax etc. she says she needs that for the other carers holiday pay and tax, ni so doesn't have enough to give me the holiday pay
